Terms and Conditions

 

1. Introductory Provisions
General Terms and Conditions apply to all customers staying in Hotel Gabriela and using its services (hereinafter referred to as the „Terms and Conditions“) and form an integral part of the Accommodation Agreement together with the Accommodation Regulations.


2. Parties to the Agreement:
a) Hotel Gabriela is operated by Karolstav s.r.o. with registered office at Nechvílova 1857/6, Prague 4, 148 00, Czech Republic, IČ: 24719994, DIČ: CZ 24719994, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 168655 (hereinafter referred to as the „Accommodation Provider“).

b) Customer – as a natural or legal person (hereinafter referred to as the „Customer“).
 
3.Subject-matter of the Agreement :
The subject-matter hereof is the provision of accommodation services and other services to the Customer in the agreed extent.
The contractual relationship between the Accommodation Provider and the Customer is established by the conclusion of the Accommodation Agreement (hereinafter referred to as the „Agreement“), i.e. the delivery of the order by the customer and its confirmation by the Accommodation Provider. The Agreement may be concluded in writing or by long distance communication means such as fax, e-mail, telephone or by the reservation form at www.hotelgabriela.cz.
In the event that the Customer is a legal person, the Agreement must be concluded in a manner and by a person authorized to act on the legal person’s behalf in accordance with the law.
The Agreement is valid and binding for persons stated in the Agreement. The Customer is liable for the contractual obligations of other registered persons like his/her own. The mutual contractual relationship is governed by these Terms and Conditions and by provisions of the Civil Code and the Commercial Code. The Czech law is the applicable law. The courts of the Czech Republic have jurisdiction in the event of any possible legal disputes.

 
4. Payment Terms
The Accommodation Provider has the right to advance payment for the services before their provision and the Customer shall pay the price of the services before their provision. The obligation of the Customer originates upon the conclusion of the Agreement when the Customer is obliged to pay 50% of the determined price of services on grounds of an invoice for advance payment sent by the Accommodation Provider. The remaining balance of the total price of services shall be paid by the Customer when checking in or using the given service provided by the Accommodation Provider. The date of payment is the date of acceptance of cash or the date when the payment is credited to the Accommodation Provider’s account depending on the method of payment up to 100% of the determined price of services. If this obligation is violated by the Customer, the Accommodation Provider has the right to withdraw from the Agreement which does not affect its right to compensation for damages.
 
5. Prices and their Changes, Changes in Ordered Services
The price of stays and possible other services are listed in the Price List or at the website www.hotelgabriela.cz. The Accommodation Provider shall notify of any changes in the price of stay in writing no later than 14 days before the provision of the services. If this new price is higher than the price stated in the Agreement by more than 10%, the Customer is entitled to withdraw from the Agreement in writing and the entire paid price of services shall be returned to the Customer without undue delay. If the Customer does not withdraw within 7 days after the notification of the price changes, it is considered that the Customer agrees with the new price.
If the Customer does not use the agreed and paid services (late check-in, early check-out, unused partial services etc.), he/she is not entitled to any compensation.
If such change in the wording of the Agreement is required, which does not change the agreed subject-matter of the Agreement, such as change in the Client’s name, type of services etc., the Customer shall pay a flat-rate fee of CZK 200.
The date may be changed on grounds of a written notice of the Customer at least 7 days before the scheduled arrival.

6. Rights and Duties of the Customer
The Customer has the right:
 
  • to proper provision of contracted and purchased services
  • to obtain information about facts relating to the agreed and paid services
  • to notify of the changes of travellers and possibly to withdraw from these Terms and Conditions and the right to complaints of the defects of the services

The Customer is obliged:
 
  • to report the participation of foreign nationals
  • to pay the agreed price of services or the cancellation fee in the event of cancellation of services
  • to provide cooperation necessary for the provision of the services and the acceptance of documents necessary for the use of services
  • to meet health requirements before travelling, to respect the Accommodation Regulations of the Accommodation Provider and act so as to avoid damage to health or property
  • in the event of change of the person/participant-traveller, the change may be made in writing with the Accommodation Provider no later than 7 days before the scheduled arrival
  • to become familiar with the Accommodation Regulations of the Accommodation Provider and respect these Regulations

The Customer – a legal entity – is also obliged:
  • to familiarize the participants with these Terms and Conditions and the Accommodation Regulations
  • to ensure that the basic obligations of the Customer are followed by all participants
  • to submit a list of names of the participants and appoint a responsible representative as a partner for communication with the Accommodation Provider

7. Rights and Duties of the Accommodation Provider
The rights and duties of the Accommodation Provider are related to the rights and duties of the Customer.
  • Withdrawal from the Agreement by the Customer, cancellation fees

The Customer has the right to withdraw from the Agreement at any time before check-in or the commencement of use of the services. The cancellation requires written form. The delivery of the written notice to the Accommodation Provider is decisive for the determination of the time of cancellation.

  • The cancellation fee is as follows:
    56 days and more 50 %
    28 days before the scheduled arrival 100 %
  • Cancellation of the stay by the Accommodation Provider

The Accommodation Provider is entitled to change the agreed conditions of the stay in the cases that it cannot influence (e.g. changes in providers of services, unforeseen circumstance etc.). The changes must be announced at least 10 days before the provision of the first service. If the Customer does not agree with the changes, he/she are entitled to withdraw from the Agreement without undue delay. The Customer shall also receive back the full amount paid for the stay. The Customer is not entitled to any further compensation.

  • Complaints
  • The Customer shall immediately announce her/his claims. In the event of a complaint, the Customer shall exercise his/her claims of defects without undue delay directly with the Accommodation Provider in the place of stay so that the defects can be removed on the site. If this is not possible, the Customer shall write a written complaint with the Accommodation Provider. If the complaint is not submitted immediately, the Customer’s claim for compensation for incurred damages, which could have been prevented by timely submission, is reduced or terminated.
  • If there are circumstance, the emergence, progress and eventually the result of which is not dependent on the will, activity and actions of the Accommodation Provider (force majeure), due to which the Customer does not fully or partly use the ordered and purchased services provided by the Accommodation Provider, the Customer is not entitled to a refund of the paid price or a discount incl. any further financial compensations and settlements.

Final Provisions
The Terms and Conditions entered into force on 1 August 2010 and apply to services and stays ordered for the years 2010 and 2011.
